Limitations and requirements in accumulating TWW

There are specific requirements for accumulating preservative TWW that are intended to prevent unauthorized access and minimizes run-off from the TWW.

To prevent unauthorized access, use a visual control or a physical barrier when not under the direct control of the person responsible for the TWW.

TWW generated as part of the maintenance of a household is exempt from the accumulation requirements listed below if all the following requirements are met:

  • The TWW is not physically altered except for resizing to facilitate transport or reuse.
  • The TWW may not be stored for more than 30 days.

TWW generated from the operation of a business is exempt from the accumulation requirements listed below if all the following requirements are met:

  • The TWW is not physically altered except for resizing to facilitate transport or reuse.
  • No more than 1,000 lbs. of TWW may stored at one time.

For those who do not meet the household or business exemptions, you must use one of the following methods:

Block and tarp

  • Elevate TWW to prevent contact with the ground and to protect it from water run-on from outside sources
  • Cover TWW to protect it from precipitation
  • TWW may be accumulated for no more than 90 days from the date of generation or received from another handler.

Containerize

  • TWW can be stored in a sealable shipping container designed to eliminate release of materials under normal incidental handling.
  • Container must be water resistant if exposed to precipitation or run-on/off
  • Accumulation is limited to less than one year from the date of generation or received from another handler.
  • Once a container is filled to capacity with TWW, it must be transported to an approved facility within 90 days.

Storage Building

  • TWW may be stored in a structurally sound building with a water-resistant floor designed to prevent the movement of water in or out of the building.
  • Accumulation of TWW in a storage building is limited to less than one year from the date of generation or received from another handler.

Containment Pad

  • The containment surface on a pad must prevent TWW from contacting the ground and must offer protection from run-on as well as precipitation.
  • TWW may be uncovered if the containment surface is designed to contain all precipitation and the resulting water is managed in accordance with applicable laws and regulations.
  • Accumulation is limited to less than 180 days from the date of generation or received from another handler.

Other

  • TWW may be stored if the method clearly demonstrates the TWW is protected from run-on and run-off and is placed on an impervious surface or not in contact with the ground.
  • Accumulation limited to less than 90 days from the date of generation or received from another handler.

In all cases, TWW may not be accumulated for more than one year from the date of generation or received from another handler if the accumulation is for the sole purpose to accrue quantities of preservative TWW to facilitate disposal.

Irrespective of the storage method used, the person accumulating TWW must be able to demonstrate the length of time it has been accumulated from the date received or became a waste.
